Furthermore, technological advances and an increased understanding of the laws of nature have allowed humans to manipulate those laws for their own purposes. In this development, Nishitani believes that “the perversion that occurred in the original relationship of man to the laws of nature has taken the shape of a fundamental intertwining of the mechanization of man and his transformation into a subject in pursuit of its desires, at the ground of which nihility has opened up as a sense of the meaninglessness of the whole business.” 2Both Nishitani and Karl Rahner see in the development of science and technology a tendency to manipulate the laws of nature for one’s own benefit in a way that increases the self-centeredness and self-absorption of humankind while at the same time devaluing humanity and engendering an attitude of meaninglessness. In a world today that is confronted with issues such as war and global warming and in which religious communities are trying to make sense out of scientific issues such as stem cell research and cloning, the ability to address a nihilistic standpoint that sees the surrounding world as simply being at human disposal has never been more crucial. So how does one confront this crisis of a nihilistic culture? Abe recommends that both Buddhism and Christianity need “to pursue a fundamental reorganization in characterizing their faith such that the prevailing basic assumptions are drastically changed—for example, a revolutionary reinterpretation of the concept of God in Christianity and the concept of Emptiness in Buddhism—thereby allowing a new paradigm or model of understanding to emerge.” 3 The concept of emptiness or nothingness in Keiji Nishitani’s Religion and Nothingness and the concept of God as incomprehensible mystery in the theology of Karl Rahner 4 could allow for the [End Page 27] emergence of a model of understanding that addresses the problem of irreligion or nihility from an interreligious perspective.5 While in no way negating the very real dissimilarities between the concepts of Nishitani and Rahner or the respective religious traditions of which they are a part, one need not think of their concepts as diametrically opposed to one another in such a way that dialogue is impossible. To that effect, this essay will explore the common ground between Nishitani’s concept of śūnyatā6 (often translated or defined as ku /emptiness or mu /nothingness) and Rahner’s incomprehensible God 7 based on their interpretations of the human experience of meaninglessness and the need for a surrender of the self that manifests itself in one’s loving relationship with others. Common human experience, such as the experience of death or meaninglessness, and the interpretations of that experience found in various religions can provide ground from which to begin interreligious dialogue. One can search for a connection between the religious concepts by looking at the way they make sense out of a common affective experience without requiring an absolute identity between the cognitive religious concepts themselves.8 The important point of comparison is not manufacturing a false identity between the concepts, but the way the concepts work within the living communities to move one to volitive action. In this way the practical or ethical implications of the concepts and how they are lived out in the world become the focus. In the work of Nishitani and Rahner, that common human experience is the meaninglessness encountered in the world today and the call for a selfless love that will transcend such meaninglessness. In this article, we present ideas related to three key aspects of mindfulness training: the regulation of attention via noradrenaline, the importance of working memory and its various components (particularly the central executive and episodic buffer), and the relationship of both of these to mind-wandering. These same aspects of mindfulness training are also involved in the preparation and execution of movement and implicated in the pathophysiology of psychosis. We argue that by moving in a mindful way, there may be an (...) additive effect of training as the two elements of the practice (mindfulness and movement) independently, and perhaps synergistically, engage common underlying systems (the default mode network). We discuss how working with mindful movement may be one route to mindfulness training for individuals who would struggle to sit still to complete the more commonly taught mindfulness practices. Drawing on our clinical experience working with individuals with severe and enduring mental health conditions, we show the real world application of these ideas and how they can be used to help those who are suffering and for whom current treatments are still far from adequate. A recent article in this journal described practical and conceptual difficulties faced by public health researchers studying scabies outbreaks in British residential care facilities. Their study population was elderly, decisionally incapacitated residents, many of whom lacked a legally appropriate decision-maker for healthcare decisions. The researchers reported difficulties securing Research Ethics Committee approval. As practicing healthcare ethicists working in a large Canadian research hospital, we are familiar with this challenge and welcomed the authors’ invitation to join the discussion of the ‘outstanding (...) ambiguities and further questions’ that their experience uncovered. We propose a Power of Attorney for Research as one substantive solution to help address the problems they identified. Although we acknowledge the familiar shortcomings associated with Advance Directives in the clinical context, we believe that Powers of Attorney for Research Participation, accompanied by Advance Research Directives, may increase the likelihood of gaining deeper understandings of potential participant’s values and priorities and how they might apply to foreseeable research opportunities. Attention-deficit/hyperactivity disorder (ADHD) is currently defined as a cognitive/behavioral developmental disorder where all clinical criteria are behavioral. Inattentiveness, overactivity, and impulsiveness are presently regarded as the main clinical symptoms. The dynamic developmental behavioral theory is based on the hypothesis that altered dopaminergic function plays a pivotal role by failing to modulate nondopaminergic (primarily glutamate and GABA) signal transmission appropriately. A hypofunctioning mesolimbic dopamine branch produces altered reinforcement of behavior and deficient extinction of previously reinforced behavior. This gives rise to delay (...) aversion, development of hyperactivity in novel situations, impulsiveness, deficient sustained attention, increased behavioral variability, and failure to “inhibit” responses (“disinhibition”). A hypofunctioning mesocortical dopamine branch will cause attention response deficiencies (deficient orienting responses, impaired saccadic eye movements, and poorer attention responses toward a target) and poor behavioral planning (poor executive functions). A hypofunctioning nigrostriatal dopamine branch will cause impaired modulation of motor functions and deficient nondeclarative habit learning and memory. These impairments will give rise to apparent developmental delay, clumsiness, neurological “soft signs,” and a “failure to inhibit” responses when quick reactions are required. Hypofunctioning dopamine branches represent the main individual predispositions in the present theory. The theory predicts that behavior and symptoms in ADHD result from the interplay between individual predispositions and the surroundings. The exact ADHD symptoms at a particular time in life will vary and be influenced by factors having positive or negative effects on symptom development. Altered or deficient learning and motor functions will produce special needs for optimal parenting and societal styles. Medication will to some degree normalize the underlying dopamine dysfunction and reduce the special needs of these children. The theory describes how individual predispositions interact with these conditions to produce behavioral, emotional, and cognitive effects that can turn into relatively stable behavioral patterns. Selon ce discours, un manque ou une insuffisance de règles ferait en sorte que les personnes appelées à statuer sur des demandes d’accommodements n’auraient d’autre choix que de se rabattre sur leurs convictions personnelles en matière de justice ou sur les circonstances particulières de la demande. En partant de l’exemple de la Loi (...) favorisant le respect de la neutralité religieuse de l’État et visant notamment à encadrer les demandes d’accommodements pour un motif religieux dans certains organismes, dont l’un des objectifs est d’enrayer ce problème perçu en adoptant les « balises » qui font défaut, nous entendons montrer que cette rhétorique véhicule une série de mythes sur le droit. | : A certain narrative emerged during the debate on religious accommodation in Québec, according to which the law suffers from a lack of rules in that area. As a result, decision-makers that are responsible for granting accommodations – it is said – have no choice but to base their decisions on personal beliefs about justice and/or on particular circumstances of the case at hand. Using the example of the Act to foster adherence to State religious neutrality and, in particular, to provide a framework for requests for accommodations on religious grounds in certain bodies, which aim is in part to fix this perceived problem by adopting the rules that are said to be missing, this article attempts to show that this rhetoric is penetrated by a number of myths about the law. The article explores the rich and varied experiences of a collective writing project, unfolding through an anecdote involving Charlie, a young boy who creatively disrupted conventional photography methods. This incident, during an evening promenade by the sea in Ericeira (Portugal), epitomizes the project's embrace of playfulness and exploration of diverse perspectives–materialized through Charlie's playful insistence on experimenting with different angles. The event embodied the group’s approach to writing, leading to a collective inquiry into the interplay of ages, angles, and other (...) themes like waves, threads, shadows, and liminal spaces. The project, driven by the Between Ages Collective, began with informal gatherings in Plymouth, UK, and expanded into a year-long online reading group. Participants, spanning different generations and academic stages, shared various materials, including films, picture books, and scholarly texts, which inspired individual contributions. Influenced by the Collective's collaborative spirit, these contributions explore the concept of 'between ages' – a metaphorical and literal space of transition and fluidity. Contributors were invited to craft pieces that delve into the 'between ages' theme, often exploring serendipitous moments that transform interactions and experiences. The writing tries to capture a sense of openness and curiosity, embracing the uncertainties and ambiguities inherent in the process. The works do not strictly adhere to conventional academic or narrative forms but rather emerge from the collective's shared experiences, including cooking, eating, swimming and walking together. The article suggests that these writings are not meant to be definitive or conclusive but are explorations that invite readers to engage with the mundane and profound textures of everyday life. The stories and themes explored are marked by their diversity in style, rhythm, and imagery, ranging from reflections on the philosophy of shadows to the profound implications of intergenerational and interspecies relationships. The Collective’s work is presented as an ongoing experiment in thinking and writing together, with each piece offering unique insights into the fluid and often blurred boundaries between different states of being. This openness to the in-between spaces brings into question the notion of fixed identities and experiences, inviting a more nuanced understanding of the relational dynamics that shape existence. Picking up the question of what FLaK might be, this editorial considers the relationship between openness and closure in feminist legal studies. How do we draw on feminist struggles for openness in common resources, from security to knowledge, as we inhabit a compromised space in commercial publishing? We think about this first in relation to the content of this issue: on image-based abuse continuums, asylum struggles, trials of protestors, customary justice, and not-so-timely reparations. Our thoughts take us through the different (...) ways that openness and closure work in struggles against violence, cruel welcomes, and re-arrangements of code and custom. Secondly, we share some reflections on methodological openness and closure as the roundtable conversation on asylum, and the interview with Riles, remind us of #FLaK2016 and its method of scattering sources as we think about how best to mix knowledges. Thirdly, prompted by the FLaK kitchen table conversations on openness, publishing and ‘getting the word out’, we respond to Kember’s call to ‘open up open access’. We explain the different current arrangements for opening up FLS content and how green open access, the sharedit initiative, author request and publisher discretion present alternatives to gold open access. Finally drawing on Franklin and Spade, we show how there are a range of ‘wench tactics’—adapting gifts, stalling and resting—which we deploy as academic editors who are trying to have an impact on the access, use and circulation of our journal, even though we do not own the journal we edit. These wench tactics are alternatives to the more obvious or reported tactic of resignation, or withdrawing academic labour from editing and reviewing altogether. They help us think about brewing editorial time, what ambivalence over our 25th birthday might mean, and how to inhabit painful places. In this, we respond in our own impure, compromised way to da Silva’s call not to forget the native and slave as we do FLaK, and repurpose shrapnel, in our common commitments. (shrink)

In December 2010, the governor of Mississippi suspended the dual life sentences of two African American sisters who had been imprisoned for sixteen years on an extraordinary condition: that Gladys Scott donate a kidney to her ailing sister Jamie Scott. The Scott Sisters’ case is a highly unusual one, yet it is a revealing site for inquiry into US biopolitics more broadly. Close attention to the conditional release and its context demands a broader frame than traditional bioethics and helps (...) to push science and technology studies analysis of race past its conventional focus on genetics. This article draws on the Scott Sisters’ case as a site for interrogating the US context of racialized mass incarceration and kin-oriented and consumerist valorization of organ donation. Tensions between racialized exclusions, the promise of consumerist freedom, and the lack of expectations of the state are foundational to a distinctly American biological citizenship. By putting the Scott Sisters’ case into conversation with broader arguments about incarceration as a site of racialization and STS literatures of organ transplantation and of biological citizenship in diverse geographical sites, this article seeks to articulate some of the racialized contours of biopolitics in the United States. With the publication recently of two valuable studies on Attic demes, we are now more fully aware of what we know, and do not know, of the deme. With Osborne's work, we now have some idea of the tendency of Athenians to own and maintain property in the deme of origin, but the role of marriage in consolidating property in that deme is more difficult to assess. In contrast to Osborne's focus on the ancestral deme, this brief study will concentrate (...) on the deme into which the woman married; such a deme will be termed the deme of marriage or the marital deme. The study will focus particularly on the families who contracted more than one alliance for their kinswomen into the same outside deme and will emphasize the importance of siblings in securing and maintaining these alliances in the marital deme. The dynamic developmental theory (DDT) has benefited from the insights of the commentators, particularly in terms of the implications for the proposed steepened delay gradients in attention-deficit/hyperactivity disorder (ADHD). The introduction of modified memory processes as a basis for the delay gradients improved the links to aspects of ADHD. However, it remains unclear whether the hyperactive-impulsive and inattentive subtypes are separate subgroups or may be explained as different outcomes of the same genetic factors and thus explicable by the same principles. (...) The DDT suggests that altered reinforcement and extinction processes define an endophenotype in ADHD that can be related dimensionally to inattention, hyperactivity, and impulsivity. The relation between the suggested endophenotype, characterized by changes in basic learning mechanisms, and other endophenotypes characterized by delay aversion or response disinhibition, needs to be tested in future studies. Le logicisme de Russell consiste en une thèse affirmant que toutes les mathématiques pures peuvent être exprimées à l’aide de constantes logiques et de variables. Il est compris habituellement comme une réduction des mathématiques pures à la logique. Pourtant cette thèse est une garantie de non-réduction des mathématiques au nombre et à la grandeur, de l’arithmétique aux seuls nombres finis, de la géométrie à celle d’Euclide, de la logique à la syllogistique. Le logicisme ne peut donc être interprété comme (...) doctrine positive et dogmatique d’un fondement logique des mathématiques. L’œuvre philosophique de Russell poursuit par ailleurs une critique des thèmes liés aux fondements. L’ensemble des points de vues de Russell sur les liens de la lo­gique et des mathématiques ne peut être compris qu’en considérant la logique comme une science à part entière et non comme un langage formel. Cette façon d’aborder le logicisme fait voir des perspectives « hétérodoxes » auxquelles est amené Russell, qui n’est pas partout le « classique » que la littérature décrit trop vite. Cette lecture s’appuie notamment sur la correspondance récemment éditée entre Bertrand Russell et Louis Couturat (1897-1913). (shrink)

This article reconstructs the development of Kurt Walter Zeidler's argument for a reformulation of Kant's transcendental dialectic as a theory of the foundation of transcendental logic. It therefore examines his doctoral dissertation "Logik des Erkenntnisprozesses. Dedukton - Induktion - Abduktion" (1979), where he discusses Norwood Russell Hansons 'logic of discovery' and finds an analogy between Charls S. Peirce's definiton of 'abduction' and Hegel's defintion of 'analogy', as well as his early papers, collected in "Grundlegungen. Zur Theorie der Vernunft und (...) Letztbegründung" (2015), and his habilitation dissertation "Vernunft und Erfahrung. Untersuchungen zum Erkenntnisproblem in Philosophie und Wissenschaftstheorie" (1986), where he first seeks to verify the claim of Hegel and Peirce, that the synthetical unity of apperception is to be analyzed as a unity of three forms of syllogism corresponding to Aristotle's three figures of syllogism, through a close study of Kant's transcendental deduction of the categories as well as of the transcendental ideas, before he comes to reformulate these deductions in the light of the original unity of sensuality and understanding. The development of this argument is critically examined in three respects, first, in reference to Zeidler's reading of Peirce, Hegel and Schelling, second, with respect to Zeidler's analysis of scientific rationality as well as of the architectonic of the Critique of pure reason, and third, in view of the influence of Erhard Oeser and Erich Heintel on Zeidler's thought. In a recent article, Christopher Ormell argues against the traditional mathematical view that the real numbers form an uncountably infinite set. He rejects the conclusion of Cantor’s diagonal argument for the higher, non-denumerable infinity of the real numbers. He does so on the basis that the classical conception of a real number is mys- terious, ineffable, and epistemically suspect. Instead, he urges that mathematics should admit only ‘well-defined’ real numbers as proper objects of study. In practice, this means excluding as (...) inadmissible all those real numbers whose decimal expansions cannot be calculated in as much detail as one would like by some rule. We argue against Ormell that the classical realist account of the continuum has explanatory power in mathematics and should be accepted, much in the same way that "dark matter" is posited by physicists to explain observations in cosmology. In effect, the indefinable real numbers are like the "dark matter" of real analysis. (shrink)

In 2012, chief nursing officers (CNO) in England published a policy on compassion in response to serious criticisms of patients’ care. Because their objective is fundamentally to shape nursing, this study argues, following Popper, that the policy should be analysed. An appraisal tool, developed from Popper, Gadamer, Jauss and Thiselton, is the framework for this analysis. The CNO policy document identified six values and behaviours, termed ‘6Cs’, required by all nurses, midwives and care staff. The document contains no data, references (...) or acknowledgements, but is similar to the 6Cs defined by the Canadian nursing nun, Sister M. Simone Roach, in her theory of caring published 30 years earlier. Roach considered caring and the components of it, including compassion, to be moral virtues, an inner motivation to care. This study suggests that without explicit reference to Roach's ideas, and her underlying theoretical base, the CNO requirement has the effect of turning virtues into commodities and a form of external control, described by Ritzer as a McDonaldized dehumanization. This study, which has international relevance beyond England and the UK, suggests that the CNO revise their policy by acknowledging Roach's 6Cs and openly discuss the implications of her work for their policy. In our view, however, the principle of embodied artificial intelligence (AI) in the robot suggests some kind of embodiedness of the image of God in human beings if they are to learn to relate to God.Foerst's description of how people react (...) to a humanoid robot reads like Otto's description of the divine as mysterium fascinans et tremendum (awesome and alluring mystery). This edition of the early diaries of Rudolf Carnap (1891–1970), which are housed in the Carnap estate at the University of Pittsburgh, was published in two volumes by Felix Meiner Verlag Hamburg in 2021 and 2022. These are also the first two volumes of the Meiner Edition Schriften aus dem Nachlass von Rudolf Carnap. The title of these two volumes is succinctly Rudolf Carnap. Tagebücher (Rudolf Carnap. Diaries), supplemented by the respective indication of the volume. Volume 1 (approx. 600 pages) (...) comprises the diaries from 1908 to 1919, Volume 2 (approx. 900 pages) those from 1920 to 1935. With these volumes, the diaries of one of the central thinkers of the Vienna Circle and Logical Empiricism become accessible to a wider circle of researchers and interested parties. While the diaries were previously only partially accessible, they have now for the first time been released in their entirety in the form of a proper text-critical edition. The editor is Christian Damböck with the collaboration of Brigitte Arden, Roman Jordan, Brigitte Parakenings and Lois M. Rendl. Text transcriptions of the originals, which Carnap had written in shorthand, served as the basis for the edition. The transcription was done by Brigitte Parakenings and Brigitte Arden, further editing by Lois M. Rendl and Roman Jordan. (shrink)

L'ouvrage publié réunit les actes d'une journée d'étude consacrée à L'imprévu et le droit, souhaitée par les doctorants et organisée par l'Ecole doctorale de droit comparé de l'Université Paris 1 Panthéon-Sorbonne. Le sujet est immédiatement apparu très riche. Si le terme d'imprévu n'est pas essentiellement juridique, il fait écho à des critères du droit tels que la prévisibilité d'une situation ou d'un texte, ou l'imprévisibilité d'un événement comme cause exonératoire de responsabilité. Il renvoie plus généralement à l'exigence de sécurité juridique (...) qui s'opposerait à l'imprévu juridique. En outre le contexte était des plus propices, quelle que soit la discipline concernée, droit public, droit privé et/ou droit pénal. L'imprévu est entendu comme tout ce qui n'a pas été prévu, tout ce qui arrive lorsqu'on ne s'y attend pas. Prévoir, c'est admettre comme probable. La question de l'imprévu confronté au droit est intéressante car les deux concepts semblent antinomiques. Le droit apparaît en effet comme quelque chose de figé, permettant de régler par anticipation les comportements humains. Il doit permettre à chacun de régler sa conduite puisque nul n'est censé ignorer la loi. Le droit doit donc être à la fois connu et prévisible dans ses effets même s'il n'en est pas toujours ainsi. La notion d'imprévu semble rencontrer le droit de deux manières. D'une part, il existe la norme imprévue : la norme nouvelle, la coutume en formation ou l'interprétation surprenante. Se posent alors les questions de la prévisibilité du droit, et corrélativement celle de la sécurité juridique. D'autre part, il y a le fait imprévu. La norme doit se saisir de comportements humains ou de situations de fait qui n'avaient pas été anticipés. L'appréhension du risque et de la survenance d'événements inattendus par des règles de droit préexistantes devient alors un enjeu essentiel. (shrink)

This is a reply to comments on my paper Cog, a Humanoid Robot, and the Questions of the Image of God; one was written by Mary Gerhart and Allan Melvin Russell, and another one by Helmut Reich. I will start with the suggested analogy of the relationship between God and us and the one between us and the humanoid robot Cog and will show why this analogy is not helpful for the dialogue between theology and artificial intelligence (AI). Such (...) a dialogue can succeed only if both our fascination for humanoids and our fear of them are equally accepted. Any avoidance of these emotions, as well as any rejection of the possibility that Cog might one day be humanlike, destroy the dialogue. The interpretation of both scientific theories and religious metaphors as stories replaces seemingly “rational” arguments with the confession of the respective commitments to a body of stories and opens up a space for exchange and friendship between AI‐researchers and theologians—an option that usually remains closed. RésuméCet article examine le duel à l’époque moderne entendu à la fois comme la forme suprême de la querelle, son aboutissement naturel sous certaines conditions, alors qu’il est lui-même objet de controverses vives. Le duel, qui repose sur des lois, réglemente le dissensus en même temps qu’il le porte à son paroxysme. Il peut servir de révélateur de la place du dissensus dans la société, de la façon dont les rapports sociaux prennent acte du désaccord entre les individus et (...) réglementent les façons de le résoudre. Cet article examine la forme du duel comme fin des querelles. Il se porte ensuite sur les controverses autour des duels. Il examine enfin la place du duel dans la littérature, sa fonction poétique et dramatique, afin de souligner les façons dont le texte littéraire participe de cette réflexion sur le duel. (shrink)
